PointsView Purchase Terms and Conditions

Please read these terms before purchasing a PointsView historical report. By completing a purchase, you confirm that you have read and accepted these terms.

  1. The product

    A PointsView report is an occupation-specific historical information product relating to the occupation and ANZSCO code identified at checkout. The report presents available historical SkillSelect information, patterns and analysis for that occupation. The scope and amount of available information may differ between occupations. PointsView reports are offered in different report coverage categories. The applicable price is the price displayed at checkout before payment is made and may currently be AUD $60, AUD $90 or AUD $120 depending on the report coverage category. No separate card surcharge is added by Shada Migration Services at checkout.

  2. Selected occupation and report

    The purchaser is responsible for checking the occupation title and ANZSCO code displayed before completing payment. The purchase relates only to the particular occupation report identified at checkout. Purchasing one PointsView report does not provide access to reports for other occupations.

  3. Personal use only

    The report is licensed to the purchaser for personal or internal use only. It must not be forwarded, shared, copied, reproduced, uploaded, published, sold, resold, redistributed, commercially exploited or otherwise made available to another person or organisation without prior written permission from Shada Migration Services, except where permitted by law. Purchase of a report does not transfer ownership of the report or any intellectual property contained in it.

  4. Personalised report and watermarking

    A purchased report may be personalised with information identifying the authorised purchaser and purchase, including the purchaser's name and PointsView order reference. This information may appear as a visible licence watermark or other identifying mark on pages of the delivered PDF. The purchaser must not remove, obscure, alter or attempt to defeat any purchaser identification, watermark, licence notice or other protection applied to the report.

  5. Historical information, not migration advice

    PointsView reports provide historical information and analysis only. They are not personalised migration advice and do not assess the purchaser's individual eligibility, circumstances, points claims or prospects. A PointsView report does not predict whether an invitation will be issued, guarantee nomination, invitation, visa grant or any other migration outcome, establish a minimum or guaranteed invitation score, establish current state or territory nomination eligibility, or replace professional migration advice concerning an individual's circumstances.

  6. Data coverage and limitations

    Historical information may vary by occupation, reporting period and migration pathway. Some source data may be unavailable, suppressed, incomplete, aggregated, subsequently revised or published only within ranges or small-number categories. Where an official source does not publish an exact figure, PointsView does not represent an estimated figure as an exact official result. The data coverage and limitations stated within the selected report form part of the description of that report.

  7. Data source and independence

    PointsView uses historical SkillSelect information derived from publicly available Australian Government reporting sources and processed through the private PointsView data archive. PointsView is a product of Shada Migration Services. It is not an Australian Government product and is not produced, approved, endorsed or guaranteed by the Department of Home Affairs. References to government data sources do not imply government endorsement of PointsView or its analysis.

  8. Electronic delivery and secure access

    Following confirmed payment, the purchased report is made available through the secure PointsView delivery system and purchase information is also sent to the email address provided by the purchaser. The purchaser is responsible for providing a correct and accessible email address. The secure download link is currently available for 7 days and permits up to 5 authorised downloads. These controls are designed to allow reasonable purchaser access while protecting reports from unauthorised distribution. The purchaser must not provide the secure download link to another person.

  9. Delivery problems

    If payment has been confirmed but the report, receipt or secure download access is not received or does not operate correctly, the purchaser should contact Shada Migration Services and provide the PointsView order reference. The purchaser should not make a second payment for the same report merely because a delivery email or download link has not arrived. Where a genuine delivery problem occurs, Shada Migration Services may restore access, reissue delivery or provide another appropriate remedy.

  10. Refunds and Australian Consumer Law

    PointsView reports are digital products prepared and securely released following confirmed payment. A refund is not ordinarily provided merely because a purchaser changes their mind after purchasing the selected report or decides that they no longer require it. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Where applicable consumer guarantees are not met, the purchaser may be entitled to a remedy provided by law.

  11. Intellectual property

    The PointsView report, together with its original selection, arrangement, analysis, explanatory material, presentation, tables, graphics, design and other original content, remains the intellectual property of Shada Migration Services or the relevant rights holder. The underlying government information remains subject to the rights applicable to that source material. Payment gives the purchaser a limited right to use the purchased report in accordance with these terms. It does not assign or transfer intellectual property rights.

  12. Unauthorised distribution

    Shada Migration Services may use reasonable technical and administrative measures to protect PointsView reports, including personalised watermarking, purchaser or order identification, restricted download links, access limits and transaction records. These measures do not restrict any rights the purchaser has under applicable law. Unauthorised copying, resale or redistribution may result in suspension of further access and may be pursued where appropriate.

  13. Changes to historical information

    PointsView reports reflect the data period stated in the particular report. Migration data, government reporting, policy settings and nomination arrangements may change after the report is generated or purchased. Shada Migration Services is not required to retrospectively update a previously purchased report merely because newer historical data later becomes available. A later edition or updated reporting period may constitute a separate PointsView product.

  14. Payment records and receipt

    Following successful payment, a payment receipt or invoice may be provided electronically. The PointsView order reference and payment transaction reference should be retained by the purchaser in case assistance with the purchase or delivery is required.

  15. Governing law

    These terms are governed by the laws applicable in New South Wales, Australia, subject to any rights or protections under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
